EASO COI Report. Country Focus

In a ‘Country Focus’ report, EASO aims to provide information focusing on ‘selected topics’ of particular relevance for international protection status determination (Refugee Status and Subsidiary Protection) for Gambian applicants. It is not meant to be a general description of the human rights situation in the country, nor a comprehensive overview of all topics at stake in international protection status determination.

This country focus is largely based on academic publications relating to The Gambia. Research work from various fields such as anthropology and politics, as well as handbooks and overviews, are the most important sources of information for the General information and State structure and politics sections.

The drafting of this report was finalised in 27 July 2017. Any event taking place after this date is not included in this report. The exceptions to this cut-off date were made during the peer-reviewing process completed on 30 November 2017, and are clearly identified in Bibliography.

This report was drafted by the Country of Origin Information (COI) unit of the State Secretariat for Migration (SEM, Switzerland) and provides a summary of the SEM’s findings on selected topics regarding The Gambia.

This report was written according to the EASO COI Report Methodology.

Beleid

Het beleid dat de commissaris-generaal voert, is gestoeld op een grondige analyse van nauwkeurige en actuele informatie over de algemene situatie in het land van oorsprong. Die informatie wordt op professionele manier verzameld uit verschillende objectieve bronnen, waaronder het EASO, het UNHCR, relevante internationale mensenrechtenorganisaties, niet-gouvernementele organisaties, vakliteratuur en berichtgeving in de media. Bij het bepalen van zijn beleid baseert de commissaris-generaal zich derhalve niet alleen op de op deze website gepubliceerde COI Focussen opgesteld door Cedoca, dewelke slechts één aspect van de algemene situatie in het land van herkomst behandelen.

Uit het gegeven dat een COI Focus gedateerd zou zijn, kan bijgevolg niet worden afgeleid dat het beleid dat de commissaris-generaal voert niet langer actueel zou zijn.

Bij het beoordelen van een asielaanvraag houdt de commissaris-generaal niet alleen rekening met de feitelijke situatie zoals zij zich voordoet in het land van oorsprong op het ogenblik van zijn beslissing, maar ook met de individuele situatie en persoonlijke omstandigheden van de asielzoeker. Elke asielaanvraag wordt individueel onderzocht. Een asielzoeker moet op een voldoende concrete manier aantonen dat hij een gegronde vrees voor vervolging of een persoonlijk risico op ernstige schade loopt. Hij kan dus niet louter verwijzen naar de algemene omstandigheden in zijn land, maar moet ook concrete, geloofwaardige en op zijn persoon betrokken feiten aanbrengen.
