The ‘Dublin III Regulation’ provides that:

  • If Belgium is responsible, the CGRS will examine the application for international protection.
  • If another EU member state is responsible, the IO requests the other member state to take over the application.
  • If the EU member state confirms the transfer but the applicant does not agree, (s)he can lodge an appeal for suspension and annulment with the Council for Alien Law Litigation (CALL).

 

From 12 June 2026, the CGRS will apply new EU rules for the asylum procedure, including mandatory recording of the personal interview, wider use of the accelerated procedure and revised rules on safe countries.
